I agree with the first and last point, but the middle one (about the cost of data warehousing) has never been a stumbling block for government regulation. How many times has the government required businesses to meet some regulation that incurs extra cost, without regard for how that cost will be paid? It's hardly anything new, and is not likely to garner much judicial (or legislative) sympathy.
