There is a difference.
I agree but the court decision should be worded correctly when it is made indicating why it is different from any previous court decisions. (I guess it will be.) The definition of the use of keywords is extremely vague.

Why can't a page contain a keyword to highlight that their product is better than the keyword product. In newspaper ads this is done all the time so why should it be different on the web?

Should Microsoft sue Red-hat because they have a whitepaper on why Red-hat is better than Windows?

Why can't a company buy keywords from Google as part of marketing research and use keywords to attract peaple who want similar products?

You are right that companies like sue. They do this to scare off the competition.
