it's HIPAA and even if it did make it illegal ...
First off it's HIPAA - don't feel bad though, SO many people make this mistake
and Secondly HIPAA does not make it illegal to release private health related information for the purpose of making a profit (what do you think you do for your doctor when you release info to him) - what it does is ENSURES THE RIGHT OF PRIVACY in regards to health of citizens of America. I agree with this totally because Privacy is important and should be respected - an Individaul, no matter what group they may be a part of, is still an Individual.
However - to get someone's genetic sequence would require 1) getting a sample to find the genetic information, 2) sequencing the information, and then 3) making this information available through documentation.
Genetic information is so personal that even if someone had this information it would do them absolutely no good unless they knew who it was for so as to know who they would be marketing a specific product to. So even if they received the information of who the Genes were from, they would then only be able to market the product to that specific individual - who should then know or at least be protected from people trying to make more profit than the value of the product provides for.
Also - Genetic information are BUILDING BLOCKS ... the whole make-up of the sequence is very personal HOWEVER the specific genes that information could be provided on are more or less the same or similar for a species. That's why we are the species of Homo Sapiens and not the species of Bob and Mike and Dave and Heather and so on.
Having the information about the different combinations of the information is what is important to human knowledge and advancing our species. The individual make-up of each person's genetics would only be useful for specific marketing and then it would be most beneficial if the information was available to the Market so that the most competitors could compete for the individual's business in helping them with their genetic problems (if any).
