Can?t there be a compromise?
Isn?t there a way to satisfy both parties? In my opinion, the ACLU will not be satisfied unless things are 100% unprotected and 100% unregulated, but here?s my suggestion, anyway.

Why doesn?t the government pass a law that more effectively categorized and restricts TLDs. So .com is actually commercial, .org is actually an organization, .lib is a library, .xxx and .sex or adult sites, .pol is political, .med is medical. This way, if some person wants to filter things, they can, and if they don?t, then they won?t. Then, if the government wants to punish people, it?s fair to everyone. Rather than just punishing one particular group, all groups will punishable for breaking this law. I think the major complaint with the law is that it singles out a particular group. And it?s telling them they can?t have free speech. If .sex. and .xxx were TDLs, then mom and pop could easily filter that from the browser, and I?m sure Google and Yahoo could allow you to filter it out as well. But the major point is that it still will be available, and then you?re no longer infringing on anyone?s civil liberties, etc.
