This is not about some broadcast equipment to have markers. If receiver plays content then nothing prevents copying with recorder that does not recognize any marks. Therfore it is and will be done anywhere. Now you may ban in the USA punishing citizens, but everywhere else wher the broadcast might get it can be recorded.

So basically are buildiong very smalll isolated world of copy protection and fancy (or irresonable) DCMA, but the rest of world does not sleep and having 95% of population can and will work how to break such protections. You have to remember that DCMA applies to very small part of this world.

Some countries even outlaw solutions that are introduced by bills in the USA.

A few years later and a few patents later and America will not be dominant in technology while its citizens will be like village people locked in their own small world when the rest have dynamic lives.

Now I do not see so many bootlegs made of broadcast. And iven if they are then I do not belive they are used in any commercial way to harm business of owners. Think about it for a moment. Bulk bootlegging will find its way anyway. That does not mean that bootlegs need to be avialble in the USA after they are obtained here. Outside of the USA Congress can do nothing... or send troops and aircraft carriers, but since China is big and powerful (and owns big chunk of US government bonds) you can set any Mickey-Mouse bill that is going to be only pain for the Amercians and nobody else.
