From the quotes, we can see what CNG thinks of its customers - they are too ignorant to figure out if they have clicked on/arrived at a competitor's web site. These lawsuits are absurd since it is basically an attempt to control the language. If somebody picks up the good old Yellow Pages and looks under 'loans' or 'cash advance' they are guaranteed to see the ads of CNG's competitors (if they exist in a particular market) - does CNG want the publisher(s) to supply horse blinkers with each copy of the phone book in order to control what the customer sees on each page?

Google IS profiting from ad sales and the use of keywords, but as the article points out it's a relatively new communications/search medium with little and/or conflicting case law. It's possible that CNG have an argument, but the "poor dumb end-user" approach sounds good but probably won't stand up. Google are not obligated to be the 'net babysitter and influence and/or enforce end-user behavior. Like Microsoft, their fat bank balance makes them a target.
