Although MSN and Yahoo already complied with their subpoena's, it was not the same thing as challenging the prosecutors in court and losing. Had they done so and lost, that would have set a precedent which would seriously hamper Google's case.

But as no precedents have been set at all, Google are coming in as first and fresh contenders to this case and I for one hope they win it outright because the Bush administration is going way out of control. If we don't resist a little, the dictatorship (under the guise of a democracy!) we're currently experiencing will become full blown dictatorship without the candy coating and then you can try and have yourself a nice life. That's a worry dude.
