Who defines "illegal"?
While I think we all agree that child porn is, and should be, illegal, beyond that we get into the question of who (or what) has the jurisdiction to define an "illegal" sex act. What if, for example, the new right wing Supreme Court reverses itself and allows states to criminalize "sodomy"? Some states haven't removed those laws from their books. If we use the definition that porn = illegal sex acts, then certain images would be illegal in some states and legal in others. How would that be enforced?

This question of multiple jurisidictions is one that the courts have side-stepped so far in their rulings against COPA. If they reinstate it, then they'll have figure out who defines "adult", "harmful", etc...
