You mis-read what the 9th Circuit said.
The judges that ruled against Yahoo were in two camps. One camp said the case was premature. The other camp said the french did not have jurisdiction. Neither opinion weakens the 1st Ammendment. Yahoos sites located outside of France are free to post what they want.
