How is this an invasion of privacy. First they had to file a John Doe lawsuit and subpeona the records from the ISP for the IP address detected that was offering the content in question. Seems very reasonalble to me.

What I'd like to see is how they prove this guy is the one who initially released the film. That'd be difficult I think.

Still this is a civil case an just providing resonalble doubt like claiming to run OS 9 when the computer could run OS 10 is not enough. You have to prove you ran OS 9 and wipping the hard drive of all evidence destroyed any evidence that could be used in the case to help the defendant.

It does make you wonder if the guy was just ignorant of the law in this case or hiding something. Either case his argument weaken by this action. In civil cases the guy with the most evidence wins so destroying ones evidence is never a good idea unless that evidence works against. There is no guilt or innocence in civil cases there are just winner and losers. You bring all before judge to decide who is right and who is wrong.

His arguments would work fine against a criminal charge of copyright infringement and he'd be found innocent for sure. That's why there is no criminal case.
