A patent covers ideas but not implementation.
In this case, Microsft is implemententing ideas that are covered by the Eolas patent. A way to think of this (as another perhaps silly patent issue) is with another company, Acacia.

Acacia is a company in Southern California that consists of a bunch of lawyers with deep pockets that purchase interesting patents dealing with broadcast of digital conatent (over the web, on TVs, etc.) both in the US and international. They don't actually come up with the ideas, they just purchase the patents. They then turn around and stick it to (initially) porn companies and small RTSP (Internet radio) broadcasters. Following their success wit this (keep in mind, Acacia is only a bunch of lawyers), they stick it to every company and indivisula doing any store and forward or broadcast of netcast of any sort.

Same basic principle behind what Eolas and Acacia does (except that Acacia purchased their patent portfolio) and people or companies (in this case, Microsoft) have to pay a fee (license fee) or find a way around the patent by implementing whatthey have in a non-infringing manner.
