I think the Supreme Court did

Not an exact quote, but the Supreme Court said that any Company that induces illegal activity activity is liable. That seems to be a pretty good guideline--problem is (don't argue political position on these examples) guns used in crimes--hold the mfgr. liable, congress has already said no; how about the mfgr of a knife used in a stabbing; booze mfgrs liable for drunk drivers--nope; tobacco companies liable for 2nd hand smoke damages--nope; rope mfgr held liable for suicides by hanging--nope; chainsaw mfgr liable for Texas Chainsaw Massacre--nope , software mfgrs liable for use to hack & spam--nope. I guess the difference is that Grokster's only use was illegal activity--copyright infringement--and they induced people to engage in that activity.
