Funny you should mention open source, for once that community (led by the W3C) actually seems to support MS on this one. Not only that, the CEO of Eolas has [url=http://www.eweek.com/article2/0,1895,1496493,00.asp]publicly stated[/url] that anyone who makes money from their browser is fair game. This includes the newly for profit [url=http://www.mozilla.org/reorganization/]Mozilla Corporation[/url], Apple (Safari), Opera, and Netscape. After all, Eolas is just like any other company, they're just out to make a buck.

They have only stated that they will provide royalty-free licenses for non-commerical entities. But really, if they win, what's to stop them? Or, picture this, Eolas wins and then somebody acquires Eolas and decides to sell their own browser. Bam, they force everyone to license only their browser and kill off all the FOSS and commercial browsers with excessive licensing fees.

Make no mistake, this definitely affects every last browser with a plug-in architecture, open-source, closed-source, free, and commercial. This isn't good news for anyone.
