The truth is somewhat more vague in a digital age.

For example, Google indexes billions upon billions of webpages, of which they earn ad revenue for doing so. You can even see snippets of the page in the search engine. The argument: without search engines, the internet would be unusable. Google/Yahoo/Ect is providing a valuable tool for society, therefore search engines are protected under fair use. Search engines are also under an opt out policy--you have to tell the various search engines not to index your pages if you don't want them indexed.

More and more books are being published every year. Someone has already mentioned readers are becoming inundated with choice, and are finding it harder and harder to shell out ten dollars for a new book they know nothing about. Therefore, it is time for an index service for books. Google is offering revenue to publishers: they have offered a percentage of the revenue earned from the ads, and I am fairly positive that the service will increase traffic to book store websites.

Google's project would become a great tool for all of us. I hope the court system agrees with them.
