I think you're confused here
---Wrong. Whenever there is money to be transacted, a deal was
struck. So some of that money is going back to the publishers
thru the Open Alliance. MS doesn't have to jump on the Google
way of doing things if it is ruled fair use which it will not. They
already paid for their permissions and are tired of being tied up
in court and want to make money.---

Microsoft is giving no money to the publishers. Zero. 0. The $5
million mentioned in the article was the amount MS will spend to
scan in the books. That pays for the physical process. No
money is given to the publishers. The books to be scanned in
are either in the public domain, or books that the publisher has
given permission for scanning to the project (and no fee was
paid for that permission).

And don't doubt for a second that MS will jump on the Google
way of doing things if it is indeed ruled to be fair use. Do you
really think MS would be happy to have a second rate product,
one that was nowhere near as useful or complete as that offered
by Google? Do you think MS would willingly pay hundreds of
millions of dollars to publishers for permissions that a court has
ruled they don't need to pay for?
