Advantage of the second mover
---Microsoft is paying $5 million to digitize 150,000 books. MS
already asked for permission. Imagine that. MS is the good guy.

Actually, MS didn't ask permission, they're just climbing on the
bandwagon that the Open Content Alliance created, they're the
ones handling the permissions. But this is an advantage of not
being the first mover in a field, you get to see the troubles the
first mover ran into and sidestep them. I guarantee you that MS
is eagerly awaiting the Google case decision, because if it's ruled
"fair use" (which would mean Google did no evil), then MS will
jump right in and forget all about permissions.
