Who buys the books
Does that really change a thing? The libraries Google is doing this for bought the books too. So Microsoft is spending 5 million create thier own library. Smart move if this proves to be the sticking point in the Google case. That's still a wait and see.

Microosoft is still in this for the money same as Google and if Google win the case with an condition that they must buy the books and can't just do this for Library then Microsoft will get the jump on them.
