Someone should tell that to the Authors Guild

Funny, the Authors Guild is suing Google for this very reason,
yet their own lawsuit features the exact same mechanism. All
members of the Authors Guild are by default included as part of
this lawsuit. If they don't agree, they have to opt out.

That's actually going to be up to a court to decide. Google's
argument, and it's a good one, is that this falls under fair use
guidelines. They scan in the books, and create a directory. It's
not like anything more of the book will be viewable to the
searcher, other than a few sentences in a typical Google search
result listing (unless Google has specifically been given
permission to display the entire text, or the book is in the public
domain). Reprinting three sentences as part of a directory is
certainly fair use.

Furthermore, if the court rules against this fair use, then that
means an end to search engines as we know them. There's no
difference between Google doing this with books and doing the
same thing with websites as they currently do. The wrong
decision here would make every search engine become "opt-in"
as well, which would greatly hinder their usefulness.
