I'm not a lawyer, so I won't argue the legal definitions of fair use.

But I think this is the best thing that could ever happen to the writing community *as a whole.*

Today people choose to consider reference books for purchase largely based on publisher or author reputation. Google is going to make it so people are much more likely to make the decision based on the relevancy of the content.

Overall, I think Google is going to increase the size of the market for written materials. But I think publishers that rely heavily on marketing may see a decrease their market share.

If this is so objectionable to publishers, why haven't they sent Google a big list of books to exclude from their search engine?

It's because they know that if this goes forward and they aren't in it, it will hurt them. They will lose sales.

Google is about to fundamentally change the nature of a market, and probably turn themselves into the single most powerful force in that market.

That's what publishers object to.
