Put those 8000 authors on the 'do not scan' list and continue regardless, start with Herbert Mitgang, Betty Miles and Daniel Hoffman and anyone on the witness list.

By refusing to identify what 'their' work is, they don't gain rights over 'ever' work and its not unreasonable to make books searchable, its a good thing! You remove their standing in the case.

Google should also make the 'do not scan' ISBN list available to anyone else that wants it, so author only have to say once that they don't want their book searchable.

And update the EULAs so you stop claiming 'unregisterable intellectual property rights' or 'pre permission of copyright', you simply undermine yourself by not standing behind your principles. Say for example if your CEO never stood up when people lobbied for privacy, yet gets annoyed when his own privacy is undermined.

My 2 cents worth, which is current Adsense earnings per click I believe.
