New lawsuit looming over Google's use of 'Gmail'?

No trademark if no trade: Sounds fake, the wayback machine doesn't mention any reference to gmail from these guys back in 2002:

They didn't register g-mail domain or any variant of it that I can find. Did they challenge anyone in 2002 for using Gmail? No?
