Lee is the big winner here...
Lee is chuckling all the way to the bank; and Google has seen no down side, as they want him to recruit employees and new graduates to start anyway. Meanwhile , Microsoft may be saying "We are really pleased with the judge's order", but let's see how pleased they are when Lee starts grabbing all the best college graduates for their new research center. The whole lawsuit is moot. By the time the research center is all setup, and they're ready to get down to some real research, the contract will have expired anyway.
Microsoft just wants to try to make an example out of Lee, but they're not doing a very good job at it. For $10mil, I'd plan on making a few trips to court also.
