Microsoft is just playing right into Googles hand here.
Even if they can get a judge to restrict what Kai-Fu Lee can do in his first year, all of this bad press plays right into Googles hand. This will just increase the number of employees that want to leave Microsoft, and also the number that do not want to work there in the first place. The biggest nightmare for Microsoft right now is their image with employees. They need to attract the best and the brightest to finish Longhorn, and all of the other projects.

Meanwhile, Google is getting all of the best picks, and does not have the bagage of protecting a dying monopoly.
