Non-issue perhaps...

To me that's a non-issue Google is not hosting the site. The
information is cached not unlike the cache of any server along
the way or a personal computer that goes to that site. Each
computer has a cache so anyone that goes to Perfect 10 that has
a cache is infringing, I think not.

Question: if I go to Perfect 10 then send a buddy the link with a
picture (without Perfect 10 permission) would I be infringing?
Remember Perfect 10 has pictures on their home page for all to
see. Perfect 10 may be doing this for free publicity perhaps. It
was once remarked, "make noise, get dirty people think you're
working". Is this similar to SCO?

If Google claims those photos as their own then yes it would be
infringing. As I see it Google isn't claiming anything just linking.
Cache is how we're able to do searches quickly. Perfect 10 has
now much free advertising they should be quite pleased.
However, because of their tirade, in the minds of many, I'm sure
they're receiving much bad publicity. People need Google, any
search engine actually, more than people need Perfect 10.
