Several inconvenient facts left out of the article
Sales of profitable ringtones are high, but complaints of deceptive tactics are also high. I got a bill for $30 worth of ringtones one month which was totally bogus. When I called and complained, the CSR didn't take 30 seconds to say "oh, it must have been a billing error, we'll take it off". No research necessary, so it must be a "common" occurence, too "common" to be a real mistake on their part.

It was an easy scam for me to spot, because I don't need to buy ringtones; it took me an hour's worth of research to determine that I could make my own. Of course not everyone will put out that much effort, but consumers learn fast, especially the younger "techno-geeks" who are the target market for digital music. The fact that you can make your own ringtones from whatever you want is almost never mentioned by the press. I know that some phones have the feature locked out, but then I would never buy the phone or the service from somone who intentionally disables customer features.
