You Can't Really Patent Air
... since it's not something that you created yourself.

However, I will soon hold the patent on a process by which oxygen can be diffused into a thick liquid and distributed throughout an entity.

So don't any of you breathe lest you violate my patent on my idea for the "Oxygen Pump".
