I think it has more to do with quality
When you download from a file swap you never know what you might get. Could be a song, could be a crapy recording or it could be a virus. Top that off with the spy ware problems that follow these download services and you've got a situation where it's worth spending $1 for a song. a friend of mine called me the other day complaining that her computer was slow. I asked her if she was file swapping again and she said yes. Sure enough her system was loaded with spy ware. After hours of frustration removing it she gave up on file swapping. I'm sure the lawsuits scare some of them but it didn't bother her in the least, the spy ware however had a big impact.
