Did you read the decisions? As far as I know, the US Supreme
Court said Grokster was liable for damages, but did not state
that they had committed a particular crime. It sounds like there
are charges being made in Australia, but the ZDNet article on it
was so vague it's hard to tell exactly what has been charged.
Note also that the Supreme Court didn't state that encouraging
infringement was what they were attacking, it's having a
business model that is dependent upon the active
encouragement of infringement. Which means it's irrelevant to
what a not for profit OSS group does, particularly if they don't
blatantly encourage infringement. The Supremes upheld
Betamax, so if the product has a legal, non-infringing use, it's
fine.

as "open source" as you chose but if the software you wrote/
provide/contributed to is used to Pirate, you my friend will go to
prison like every other scumbag criminal---
