Whose fault?
Unless I'm mistaken, images and other content aren't indexed by
search engines if they're restricted by robots.txt. And robots.txt is
one of only many ways that they could have protected their
content. If Google/A9 is taking it from a web site that stole the
images, that's who they should be going after.

If the sites aren't taking the precautions they should, I see no
reason why search engines should be sued for doing their jobs.
