There should be NO patents on software ideas
Unless they address an interaction with a physical process.

You need only read the text of any of hundreds of awarded software patents to see that they are much too broad. Just do a search of the US patent site with Microsoft as the Assignee and XML in the text. If you read them, you will notice that if you write any program that uses XML technology, you are very likely infringing on one of Microsoft's existing patents (same with Sun, and IBM, by the way). These big companies have hundreds of lawyers on staff to make sure that any small inventor will not prevail in court against them.
The fact that the BSA is happy about the proposed changes provided by Smith's bill should be a clue that they will not favor small inventors.
