If I challenged a patent that I had paperwork stating that work was mine, that is the prior art. My copyright will null and void his patent. If you have no paperwork or proof like lab results or engineering proposals or blueprints, you would be SOL like before. You do have to have proof to challenge a patent. I do think the time frame is a little bit too brief for the challenge process.
