I disagree
I didn't read anything about doing away with prior art. If on paper you file for a patent on something that has been in use for 10 years every single person using it currently can scream "Prior Art" and they have 9 months to do so. Then even if no complains there is still a 6 month period where someone can still scream "Prior Art" after a law suit for infringement has been filed.

What do you have today? Everyone just screams prior art on talkbacks like this and some company being sued just settles to avoid court costs.

So technically you could file papers to patent the wheel and if for some strange reason your are granted a patent everyone who uses wheels can point out how ridiculous this is if they do so with in 9 months. If you manage to slip past the 9 months the second you try to sue Ford for using wheels with out paying you then people have 6 months to challenge your patent again. This 6 months happens everytime you try to sue so even if you got lucky suckering some company into settling you'd still be able to get nailed on the next scam.
