I agree with your analysis. You can't have both "first to file" and prior art.

How is this not unconstitutional? The Constitution clearly and unambiguously rewards inventors, not first-filers. Assigning rights to your employer is one thing, but patent lawyers scouring unpatented prior art, and claiming ownership?

Another problem with the bill:

"The Business Software Alliance was quick to praise the bill, saying in a statement that it goes a long way toward 'improving patent quality, making sure U.S. law is consistent with that of other major countries and addressing disruptions caused by excessive litigation.'"

Other major countries don't have our Constitution. Which is more important to adhere to?

I'm waiting to see what the pro-patent posters here have to say about this one.
