I literally means that I can write a peice of original software and use it for years and then have some slime ball lawyer discover something patentable in what I have done, file the paperwork, and then OWN my idea or concept. This is a fatal flaw that will hamper grass roots innovation and reward shrewd lawyers rather than actual innovators.
