Think of newsletters and listservs...
I am going to have to assume that they are including e-newsletters and listserv messages in the category of "legitimate" bulk senders. Some of those things can have thousands of subscribers who all WANT to get the message - that kind of volume would certainly qualify as a bulk sender in my opinion.

Some filters will flag this kind of stuff as spam purely based on the fact that it's being sent to so many recipients. We are currently evaluating several anti-spam appliances and this is a problem that we are running into with some of the solutions. We are at a university and most of our faculty and a large number of our staff subscribe to numerous newsletters and listservs. We are moving from "tag and deliver" to and end-user quarantine solution and many are annoyed that their "legitimate" messages are getting blocked.
