...then maybe this isn't quite as bad as it is being made out to be. But if I'm not mistaken, copyright holders must actively protect their copyrights in order for them to be enforceable. So where does one draw the line?

And I still disagree with the idea of 'opt-out'. One should NEVER have to opt out of anything; it should ALWAYS be opt-in.
