But digitizing isn't distribution

My understanding of this is they're digitizing the books to make them searchable. They then only present snippets as search results. The publishers letter even requests they define 'snippet' better.

If you think about it, they take a snap shot of a *complete* web site. Is that a copyright violation? No, because they only make snippets and cache pages available, and you can opt out of either. Same thing here.

I think G should go one better and let them opt out of the digitization aswell simply by specifying the ISBN number.
