...if the 'fair use' provisions came out of case law and are not explicitly spelled out in copyright law, isn't it kind of misleading to be complaining about violation of fair use 'rights' in all of these new technologies? Don't we need court cases to determine the application of fair use 'rights' to new technologies? And if a court 'discovered' fair use rights, can't a court also take them away?
