Sounds like they're playing games, they want an opt in, not just for *their* books but *all* books. By making it a complicated contract dicussion / lengthy search to find the rights holder, for every book they can make it too expensive to do. That 'no right to digitize' stuff sounds like cr*p, its the distribution part thats important. Like the old MP3.com distributed the work it digitized, it wasn't the digitization it was the distribution.
I think this is major publishers trying to stay at the top of the heap.
Why don't G give them what they want. Give them an interface in which they can enter any ISBN number for any of their books they don't want scanned.
Their books won't be searchable, they won't sell as many as a result. You give them what they *say* they want and ignore the tricky subtext.
Its the same as the AFP case, you give them enough rope to hang themselves.
