How's this for a solution...?
Make it a law that all software must show a window before installation which states clearly (100 words max) who makes the software and what it's purpose is. The second paragraph must explain clearly any information gathered and sent anywhere by the program.

eg.

"This is product XXXX from YYYY corporation. It's purpose is to edit text files.

Privacy statement: XXXX gathers no information about the user."

or

"This is product XXXX from YYYY corporation. It's the best way to surf, ever! You also get free mouse cursors and you'll be more attractive to the opposite sex.

Privacy statement: Every web page you visit, every password you type in and the contents of the 'My Documents' folder may be reported to YYYY corporation."


Compliance with this law would be very simple and place no real burden on developers. It makes no type of software illegal per se, thus solving the problem of how to define "spyware". Any attempt to sum up what is and what isn't spyware is doomed to failure IMHO - the scum will just start playing word games in court.

Any software which deviates from what is stated during the installation is illegal and the boss will be thrown in the slammer for a spell with a large mass murderer named "Bubba".
