First principle flops.
I'll have to read it more closely, but as soon as I read this I knew we were in for philosophical revelry:

The primary rationale for Intellectual Property protection is, first and foremost, to promote societal development by encouraging technological
innovation. The legal monopoly granted to IP owners is an exceptional departure from the general principle of competitive markets as the best guarantee for securing the interest of society.

No, the purpose of IP is to assure that the creator of IP receives the reward expected. That's the basic principle of a capitalist society. IP is capital.

The reason that reward for work is a solemn societal obligation is that people seeking rewards will benefit society. This idea is as Adam Smith as it gets.

Set the premise badly, and you can take your argument where you want it to go.


My objection to the DMCA has to do with its oppressive content, and not with its reasonable goal. This baby doesn't go out with the bathwater.
