The concept of focusing on malicious behavior instead of the technology makes sense. Analogy: we legislate against murder, regardless of the instrument (i.e. technology) used.
The big problem will be for this camel-designing committee to avoid creating a safe harbor for malicious spyware, just as the Can-Spam Act created a legal safe harbor for much of the spam we see.
