ok.. so I am new at posting here.....

should have read like this:

These individuals who are defending against these suits, keep losing because they are starting in the middle, instead of at the beginning. By arguing that without an active case, the plaintiffs do not have the right to the information, is incorrect under commercial law. Congress does have the right to regulate commercial action, under the interstate commerce provisions of the constituion. Though, giving any class of individual what accounts to more rights within the judicial system (i.e. the power to force disclosure of what is considered private information without some form of review)can be considered suspect under the 14th amendment.
