What ISPs can do
They can dump thier logs.

They can't do that after legal notice has been given in the form of a subpoena. But if thier regular procedure is to delete the logs after 8 hrs then a subpoena is useless. All a subpoena does it this, if you have the information you hand it over. Subpoenas can not alter the way you do business. So if you delete the logs after 8 hours as a part of business not as response to a subpoena then you can continue doing business as usual.
