Recording the radio has always been fair use, so long as you don't try to sell anything you record, and listening to the radio has always been free.
Now with satellite radio, you have to pay just to listen, and they want to tell you that you can't record. What a crock! They claim that because satellite radio is CD quality, copy protection is needed. This is nonsense.
