You need to get out more...
I can walk into several stores in my burg and buy an unlocked phone, or purchase one off of the internet and then buy service with AT & T or T-Mobile or Vodaphone, no contracts, no commitments. I will pay a premium for the unlocked phone, as it gives me the freedom to choose my phone company, and the store selling me the phone receives no further revenue stream from the sale of the phone. Or, I can walk into a telco's store front, purchase a locked phone at a greatly reduced price and commit to providing the carrier with a revenue stream for the next two years. Plenty of freedom of choice, and exactly what the free market is about.

Whereas, in the EU, the legislators think the commoners are not capable of making good choices so they legislate those choices for them, which is why a pizza that cost $5.00 here costs 3 to 4 times that there. God Bless America and Pizza!
