I'd read the forum before I got the champagne out...
Sony and Panasonic are the two parents of the organization. And the weak spot is going to be patents:

Members of the forum are required by the Membership Agreement to notify the Forum of any patent claims they are aware of in code submitted to the Forum. Please see Section 4 of the Membership Agreement for details. It is expected that Members who submit code under an Open Source license to the Forum will license any patents they have in that code under terms compatible with that license. Otherwise, the submission will be rejected by the Architecture Group.

So some interesting things are to come about here. First - code submitted to/by the forum for possible inclusion to the Linux kernal will be open source. Great for that. What is not said is - what about their own internal libraries - the good stuff that does not get shared? I find it hard to belive Sony would GPL/GNU libraries that it would use for any of it's future Play Station development for example. If this scenario is correct - wow! Three card monte for the masses. Okay - so I guess it's open source when it's one to two degrees removed from proprietary? Cause from reading in the forum - unless it's got to do with the kernal they ain't promising to do diddlysquat else. Work on Linux will be open and above board, but I would not be surprised to see patents abound regarding libraries used by Sony in how the Linux Kernal is used by their hardware.

So this is better than MS by how? Great that they are throwing a bone to the open source community, and willing to support Linux, but beyond that you will probably see the same closed proprietary and patent holding process.
