I was referring to actual compression quality to loss ratio. Technically at that time ATRAC was a far better quality.

Again it depends what you listen to. Like I mentioned POP&Rock may be fine but for Classical Jazz and Trance the higher fringe frequencies are lost under MP3.

Please clarrify less-than-impressive. What are you basing this on ? What music did you listen to and how did you compare your study ? Considering you returned the item the next day (and the fact that it was XMAss and you were probably engaged in other festive activities) I very much doubt you had the time or inclination to do a proper and thorough test.

In no way did I refer to any customer service oriented quality. I know that Sony has a poor standard there.

By the way ... maybe you should have specified more clearly what you wanted for Christmass ... it would have saved you a disappointment.
