If you know that companies are infringing and you wait to enforce the patent in order to let it get so entrenched that companies have no CHOICE but to use it, then you should lose the patent, or at least lose enforcement on it.

They didn't enforce it because they knew if they did the then manfacturers would say, "screw it," and develop a new, open standard instead and then they wouldn't really make anything.
