Isn't the same with weapons, drugs and others?
If not then why so inconsistent. Possesing a drug does not mean it is trafficed (to be honest taking it without "help" should not be outlawed either). Possesion of weapons as long as they are not used can take the same result.


Otherwise... why not a fully equipped man is prosecuted for rape?

That's how "smartly" and "consistently" you built laws. That's why USE or TRANSACTION is a base for establishing formal case to outlaw ACTIVITY - not a possesion.

One could think that control how someone gets weapons and drugs rather than prosecuting for possesion could be base for judicial system of values.
